Since one of the essential principles of this legal framework is transparency, we have prepared this document through which we wish to inform you about how we collect, use, transfer and protect your personal data when you interact with us in relation to our products and services, including through our website or through the applications available on your mobile phone.

What categories of personal data do we process?

We generally collect your personal data directly from you, so you have control over the type of information you provide to us. For example, we receive information from you as follows:

When you create a SkyWash Robotics account, you provide us with: your email address, first and last name;

Within your personal page (my account) from the SkyWash Robotics platform you have the possibility to add additional information, such as: photo, gender, nickname, mobile phone number, landline number, date of birth, education level, delivery addresses, alternative email address, bank card details, etc.;

When you place an order, you provide us with information such as: the desired product, your name and surname, address

delivery details, billing details, payment method, phone number, bank card details, etc.

We also offer you the possibility to register on the SkyWash Robotics platform through your Facebook or Google account. If you choose one of these options, you will be directed to a page managed by Facebook Inc / Google LLC, where they will inform you about the transfer of your data to eMAG. SkyWash Robotics cannot be held liable for the processing carried out by third-party platform operators, in their capacity as independent operators.

We may also collect and subsequently process certain information regarding your behavior while visiting our website or using the smartphone application, in order to personalize your online experience and provide you with offers tailored to your profile. On our website and smartphone application we may store and collect information in cookies and similar technologies, according to the Cookie Policy.

We do not collect or otherwise process sensitive data, which are included in the General Data Protection Regulation as special categories of personal data. We also do not wish to collect or process data from minors under the age of 16.

What are the purposes and grounds of processing?

We will use your personal data for the following purposes:

This general purpose may include, as appropriate, the following:

  • Account creation and management within the SkyWash Robotics platform;
  • Processing orders, including taking, validating, shipping and invoicing them;
  • Resolving cancellations or problems of any kind regarding an order, goods or
    purchased services;
  • Returning products according to legal provisions;
  • Refund of the value of the products according to legal provisions;
  • Providing financing through eCredit, in collaboration with our partners Cetelem and BRD Finance;

  • Providing support services, including providing answers to your questions regarding
    your orders or to the goods and services of eMAG or partners in the eMAG Marketplace.

The processing of your data for these purposes is in most cases necessary for the conclusion and execution of a contract between eMAG and you. Also, certain processing subsumed under these purposes is required by applicable law, including tax and accounting law.

Please note that eMAG also acts as an intermediary platform. In this role, eMAG acts as a point of contact between you and our Marketplace partners, namely the entities that sell products via the eMAG platform (“vendors“). In this regard:

In order to conclude contracts between you and the Sellers, respectively for taking over and executing the orders you place on the eMAG platform in relation to the Sellers’ products, as well as for fulfilling the related legal obligations (for example, tax and accounting obligations), eMAG transmits to the Sellers from whom you purchase products/services a limited number of personal data such as:first and last name, phone number, billing address, delivery address, first and last name of the person receiving the package, phone number of the person receiving the package, order ID.With regard to this limited set of data categories and only in relation to the purposes mentioned in this paragraph, the Sellers act as joint controllers with eMAG. With regard to any requests regarding these processing operations, please contact eMAG at the contact details mentioned in the sectionWho we are and how you can contact us.

If a Seller processes your data beyond the limits set out in the previous paragraph, namely for purposes other than taking over and executing the order and fulfilling the related legal obligations, eMAG is not involved in this processing, and the Seller processes your data in accordance with its own privacy policy, which you can access in the sectionUseful information, which can be found by accessing the Seller’s page on the eMAG platform. Thus, the Seller assumes the status of an independent controller of your personal data and is solely responsible for compliance with the applicable legal obligations for any such processing. Processing data for the Seller’s own purposes and/or through its own means (via SMS, email) represents exceeding the established limits (for example, contacting customers to assess their level of satisfaction with the ordered products, marketing activities carried out by the Seller, etc.).

To improve our services

We constantly want to offer you the best online shopping experience. To this end, we may collect and use certain information about your Buyer/User behavior within the eMAG Group in order to analyze the improvement of existing products as well as the opportunity to create new products, to your advantage.

We base these activities on our legitimate interest in conducting business, always taking care that your fundamental rights and freedoms are not affected. If you wish to exercise your right to object, please send us your request at the addresses mentioned above.

For marketing

We want to keep you informed about the best offers for the products/services that interest you. In this regard, we may send you, for eMAG or on behalf of any company of the eMAG Group, any type of message (such as: e-mail/SMS/telephone/mobile push/webpush/etc.) containing general and thematic information, information on products similar or complementary to those you have purchased, information on offers or promotions, information on products added to the “Account/My Cart” section or the “Account/Favorites” section or you have shown interest in purchasing, as well as other commercial communications such as market research and opinion polls, and we may display personalized recommendations on the website and in the smartphone application. In order to provide you with information of interest to you, we may use certain data regarding your purchasing behavior (e.g. products viewed/added to wishlist/purchased) to create a profile for you. We always ensure that these processing operations are carried out in compliance with your rights and freedoms and that decisions made on the basis of them do not have legal effects on you and do not similarly significantly affect you.

In most cases, we base our marketing communications on your prior consent. You can change your mind and withdraw your consent at any time by:

  • Changing the settings in the customer account in the “My Subscriptions” section;
  • Accessing the unsubscribe link displayed within the messages you receive from us; or by
  • Contacting eMAG using the contact details described above.

In certain situations, we may base our marketing activities on our legitimate interest in promoting and developing our business. In any situation where we use information about you for our legitimate interest, we take care and take all necessary measures to ensure that your fundamental rights and freedoms are not affected. However, you can ask us at any time, by the means described above, to stop processing your personal data for marketing purposes, and we will comply with your request.

To protect our legitimate interests

There may be situations where we will use or disclose information to protect our rights and business. These may include:

  • Measures to protect the website and eMAG platform users from cyber attacks:
  • Measures to prevent and detect fraud attempts, including the transmission of information to the competent public authorities;
  • Measures to manage various other risks.

The general basis for these types of processing is our legitimate interest in defending our commercial activity, it being understood that we ensure that all measures we take guarantee a balance between our interests and your fundamental rights and freedoms.

Also, in certain cases we base our processing on legal provisions such as the obligation to ensure the security of goods and valuables provided for by the applicable legislation in this matter.

For recording telephone conversations with eMAG representatives

When you interact with eMAG representatives by phone, these phone calls will be recorded to analyze the quality of our services and your level of satisfaction, in order to improve them. You will be informed of this before the call begins and in the event that

you will continue the phone call we will consider that you have given your consent to the recording of the conversation. In the event that you do not agree to the recording of the phone call, you can contact us through the other dedicated channels, mentioned in the Contact section available here, including the Online Support chat. You can withdraw your consent at any time during the call or afterwards. However, the withdrawal of consent will not affect the processing already carried out on the basis of your consent or the recording already made. At the same time, it is possible that the deletion of personal data thus recorded will continue to be kept, based on legitimate interest or a legal obligation.

Additionally, please note that in order to avoid repeated information about the call recording, repeated request for your consent for this processing activity (“information fatigue” / “consent fatigue”), for calls made less than 24 hours apart, we will consider the information about the call recording activity and the request for consent made on the occasion of the first call.

The processing activities in this section are based on the consent for the recording of the call, expressed by you by continuing the call. Additionally, the data thus collected will also be processed on the basis of legitimate interest, when we consider purposes such as verifying and improving the quality of the services offered, measuring the performance of our agents, identifying fraud situations, transcribing and implementing statistical and mathematical models for such analyses.

How long do we keep your personal data?

As a general rule, we will store your personal data for as long as you have an account on the eMAG platform. You may at any time request that we delete certain information or close your account and we will comply with these requests, subject to the retention of certain information including after the account is closed, in situations where applicable law or our legitimate interests require it.

To whom do we share your personal data?

Where appropriate, we may transmit or provide access to certain of your personal data to the following categories of recipients:

  • companies within the same group of companies as eMAG;
  • eMAG Marketplace partners;
  • courier service providers;
  • payment/banking service providers;
  • marketing/telemarketing service providers;
  • market research service providers;
  • insurance companies;
  • IT service providers;
  • other companies with whom we can develop joint programs to offer our goods and services on the market.

If we are subject to a legal obligation or if it is necessary to defend a legitimate interest, we may also disclose certain personal data to public authorities.

We ensure that access to your data by third parties, legal entities under private law, is carried out in accordance with the legal provisions regarding data protection and confidentiality of information, based on contracts concluded with them.

To which countries do we transfer your personal data?

As a general rule, your personal data is stored and processed by eMAG within the European Union and the European Economic Area (EEA).

In the event that your personal data are transferred outside the European Union or the EEA, the transfer will be carried out (a) pursuant to Article 45 GDPR, namely on the basis of a decision of the European Commission by which it decides that the third country in question ensures an adequate level of protection, (b) pursuant to Article 46(2)(b) GDPR, namely on the basis of binding corporate rules or (c) pursuant to Article 46(2)(c) GDPR, namely on the basis of standard contractual clauses adopted by the European Commission. In addition, if we identify that one of these measures is not sufficient to ensure an adequate level of protection, on a case-by-case basis, we will adopt additional technical and/or organizational security measures in accordance with the recommendations of the European Commission.

Please note that the eMAG platform mediates the sale of products originating from multiple countries, including countries outside the EEA such as Turkey. As such, in accordance withsection “1. For the provision of eMAG services for your benefit”above, as a result of your choice to order a product offered by a Seller established outside the EEA, your personal data may be transferred outside the EEA, to a country that has lower personal data protection standards than those guaranteed within the EEA, which may involve risks regarding the processing of your data. In such cases, eMAG will apply one or more of the guarantees provided for in this section, in order to ensure an adequate level of protection of your personal data. The country in which a Seller is established can be checked on the Seller’s profile page, by clicking on the Seller’s name in the eMAG platform interface and checking the address of its registered office (for example, on the product presentation page).

You can contact us at any time, using the contact details mentioned in the “Who we are and how you can contact us”., to learn more about the countries to which we transfer your data, the transfer mechanism used, the specific content of the standard contractual clauses implemented, as well as the safeguards we have put in place regarding these transfers.

How we protect the security of your personal data

We are committed to ensuring the security of personal data by implementing measures

The transmission of your personal data is done using state-of-the-art encryption algorithms.

We use the services of the payment processor PayU to make payments. Any payment information is encrypted using HTTPS technology with TSL 1.2 encryption.

Despite the measures taken to protect your personal data, we draw your attention to the fact that the transmission of information over the Internet in general, or via other public networks, is not completely secure, and there is a risk that the data may be seen and used by unauthorized third parties. We cannot be responsible for such vulnerabilities of systems that are not under our control.

What rights do you have?

The General Data Protection Regulation recognises a number of rights in relation to your personal data. You can request access to your data, correction of any errors in our files and/or object to the processing of your personal data. You can also exercise your right to complain to the competent supervisory authority or to seek legal action. Where applicable, you may also benefit from the right to request the erasure of your personal data, the right to restriction of the processing of your data and the right to data portability.

Identity.We take the confidentiality of all records containing personal data seriously. For this reason, please send us your requests regarding such records using the email address associated with your eMAG account. Otherwise, we reserve the right to verify your identity by requesting additional information aimed at confirming your identity.

Fees.We will not charge a fee for exercising any of your rights in relation to your personal data, unless your request for access to information is unfounded, repetitive or excessive, in which case we will charge a reasonable fee in such circumstances. We will inform you of any fees applied before we deal with your request.

Response time.We aim to respond to any valid requests within a maximum of one month, unless this is particularly complicated or if you have made multiple requests, in which case we will respond within a maximum of two months. We will let you know if we need more than one month. We may ask you if you can tell us exactly what you want to receive or what concerns you have. This will help us act more quickly and shorten the time it takes to respond to your request.

Third-party rights.We must not comply with a request if it would adversely affect the rights and freedoms of other data subjects.

  • you exercise a legal right to object; or
  • they have been processed illegally; or
  • We have a legal obligation to do so.

We are not obliged to comply with your request to delete your personal data if the processing of your personal data is necessary:

  • for compliance with a legal obligation; or
  • for the establishment, exercise or defense of a right in court.

There are certain other circumstances in which we are not required to comply with your request to delete data, although these two are the most likely circumstances in which we might deny your request.

Please note that:

  • Before exercising this right, download from your eMAG account and save all documents related to orders placed with eMAG, regardless of whether the billing was made to you or to another natural or legal person (such as: invoices, warranty certificates). If you do not do this before exercising your right to deletion, you will lose all these documents and eMAG will be unable to make them available to you, as the case may be, because the process of deleting data, namely the eMAG account, with all its data and documents, is an irreversible process.
  • If you have created your account on other platforms through your eMAG account, deleting your eMAG customer account may make it impossible for you to directly access these platforms. In this case, access or use of these platforms will be in accordance with their own terms and conditions and data processing policies.

Restriction of data processing

You can ask us to restrict the processing of personal data, but only if:

  • their accuracy is disputed (see the rectification section), to allow us to

we verify their accuracy; or

  • the processing is unlawful, but you do not want the data to be erased; or
  • they are no longer necessary for the purposes for which they were collected, but you have
